Terms & Conditions1. Definitions



The Hirer: the party identified in clause 1(a) of the booking confirmation.



The Rental Company: SUSSEX CLASSIC CAR HIRE

The Authorised Drivers: the drivers identified in clause 1 (b) of the booking confirmation.



Period of Hire: As shown in clause 1(c) of the booking confirmation.



The Cost of Hire: As shown in clause 1(d) of the booking confirmation.



The Insurance Excess: As shown in clause 1(e) of the booking confirmation.



The Hire Car: As shown in clause 1(f) of the booking confirmation.



2. Our Responsibilities



(a) To use our best endeavours to provide the hire car in good and roadworthy condition to the Hirer for the Period of Hire subject to the Hirer complying with the terms herein.



(b) (i) If through reasons beyond our control of whatever nature the Rental Company cannot provide the agreed hire car for the period of hire then the Rental Company will offer to the Hirer a similar alternative vehicle.



(ii) If the Hirer does not wish to substitute the vehicle then the Hirer shall be entitled to a full refund of all costs paid.



(iii) The Rental Company accepts no liability for any consequential loss arising from its failure to provide the vehicle originally hired.



(c) To arrange comprehensive insurance for the vehicle for the Period of Hire subject to the Hirer’s compliance with his duty of full disclosure of all facts and matters relevant to the obtaining of such insurance.



(d) To provide breakdown cover for the Period of Hire.



3. The Hirer’s Responsibilities



(a) To comply with all laws of the country within which the vehicle is being used and to only use the Hire Car in England, Wales and Scotland.



(b) To comply with all the terms and conditions of hire.



(c) To only allow authorised drivers to drive the Hire Car.



(d) To use the Hire Car for social domestic and pleasure purposes only. The use of the Hire Car for all or any motorsport purposes is expressly forbidden as is the use of the Hire Car for any commercial purposes.



(e) Not to part with possession of the Hire Car to any 3rd party apart from an Authorised Driver.



(f) To lock the Hire Car and to use all security devices provided when the Hire Car is parked.



(g) Not to leave any personal possessions visible in the Hire Car when it is parked.



(h) (i) To return the Hire Car prior to the expiry of the Hire Period.



(ii) If the Hire Car is returned outside of the Period of Hire then the Rental Company shall be entitled to charge for any further periods subject to a minimum of 1 days hire charge

(i) To comply with the terms of clause 4 below relating to the care of the vehicle whilst in the Hirer’s possession.



(j) To use the proper fuel oil and additives if any for the Hire Car.



(k) To use the Hire Car in a manner proportionate to its age and condition and not to use the Hire Car in any manner likely to cause damage to the vehicle.



(l) To return the Hire Car in the same condition as when hired together with all ancillary equipment provided at the commencement of the Period of Hire at the end of the Period of Hire.



(m) Not to use the Hire Car when it is unsafe to do so.



4. Care of the Hire Car



(a) To remove the keys from the Hire Car when the Hirer or an Authorised Driver is not in the vehicle.



(b) To always lock the Hire Car and activate all security devices when leaving the vehicle parked.



(c) (i) To check and top up as necessary the oil and water in the Hire Car every 24 hours/200 miles whichever is the earlier and any damage caused to the Hire Car by a failure to comply with the terms of this sub clause shall be the responsibility of the Hirer and the Rental Company shall be entitled to charge the Hirer all repair costs in respect of any such damage.



(ii) To visually check the tyres and wheels of the Hire Car every day before use.



(d) In the event of a breakdown to immediately advise the Rental Company and thereafter to comply with any reasonable directions of the Rental Company.



5. Bookings Cancellations Payments and Additional Charges



(a) All bookings made more than 14 days prior to the Period of Hire shall pay a 25% deposit of the total Hire Charges at the time of booking. The balance of charges remaining shall be paid at least 14 days before the hire commences by credit or debit card or 21 days before by cheque.



(b) The Hirer agrees that for the Period of Hire and 7 days thereafter to provide by their credit or debit card a security deposit equal to the insurance excess.



(c) Any bookings made less than 14 days prior to the Period of Hire must be paid for in full at the time of booking and all bookings must be made at least 48 hours before the commencement of the period of hire.



(d) Any payments made in respect of a booking cancelled by the Hirer more than 14 days prior to the Period of Hire shall be refunded except for a £50 administration charge.



(e) (i) Any booking cancelled less than 14 days prior to the Period of Hire will incur a cancellation charge of 50% of the cost of hire.



(ii) Any booking cancelled less than 24 hours before the Period of Hire commences will incur a cancellation charge of 75% of the cost of hire.



(f) Any booking not paid for completely 14 days prior to the commencement of the Period of Hire will automatically be cancelled and after deduction of a £50 administration charge be refunded to the Hirer.



(g) A booking is only made when a Booking Confirmation has been sent by the Rental Company to the Hirer.



(h) At the time of booking to provide a copy of both parts of all authorised drivers driving licences and a utility bill less than 3 months old in the name of and same address as the driving licence of the Hirer and to produce both parts of the original driving licences at the time of hire together with a similar utility bill for the Hirer. If this is not done the hire will not proceed and will incur a cancellation charge of 75% as per 5(e)(ii) above.



(i) The Hirer agrees to indemnify the Rental Company in respect

of the following:-



(a) any damage whatsoever whether obvious or latent to the vehicle for which the Hirer is responsible



(b) all fines and charges of whatever nature incurred during the period of hire to the Hirer



(c) the cost of replacement of any equipment lost by the Hirer



(d) If the security deposit paid by the Hirer has been refunded to the Hirer and/or the amounts paid by way of security deposit are insufficient to discharge the Hirers indemnity then the Rental Company shall be entitled and is hereby authorised by the Hirer to raise a further charge on the Hirers debit/credit card.



(e) all costs charges and expenses whether legal or other costs incurred by the Rental Company in obtaining payment of any sums due under this agreement or seeking to recover its property.



6. Insurance



(i) The Rental Company will arrange comprehensive insurance of the Hire Car for the period of hire subject to full disclosure of all material facts and circumstances by the Hirer.

1.Should such comprehensive insurance be vitiated by any act of the Hirer then the Hirer agrees that any liability and or loss occasioned to the Rental Company during the Period of Hire is the Hirer’s responsibility and agrees that the Rental Company may charge his credit or debit card the value of any such loss in addition to any other remedies the Rental Company may have against the Hirer.


7. Entire Agreement and Governing law



This agreement comprises the entire agreement between the parties and is exclusively subject to the laws of England and Wales.
